2. Our Services
TRUP LLC develops and operates software, SaaS applications, AI-powered productivity tools, mobile applications and games, iOS and iPadOS apps, cloud hosting and infrastructure services, email and communication platforms, content creation tools, automation tools, APIs, and related digital products.
Some products may operate under separate brand names, websites, dashboards, or product-specific terms. If product-specific terms apply, those terms supplement these Terms. If there is a conflict between these Terms and product-specific terms, the product-specific terms apply only to that specific product or service.
Mobile apps, games, and Apple platforms
Some services may be distributed as mobile applications or games through Apple’s App Store or another app marketplace. Availability, features, age ratings, device compatibility, and supported regions may vary by product, device, operating system, and platform requirements.
When you download or use a TRUP app through Apple’s App Store, Apple’s applicable terms and platform rules may also apply. Apple is not responsible for providing maintenance or support for the app, except where applicable law or Apple’s terms require otherwise.
In-app purchases and subscriptions billed through Apple or another app marketplace are governed by the applicable marketplace’s payment, cancellation, and refund rules. Purchases made through our websites or direct SaaS checkout are governed by these Terms and our Refund Policy.
3. Eligibility
You must meet the age requirements disclosed for the applicable service. Unless product-specific terms say otherwise, an account holder who enters into a contract with TRUP must be at least 18 years old, or the age of legal majority in their jurisdiction. Age-rated mobile apps and games may be used by minors only with the permission and supervision of a parent or legal guardian where required.
If you use our services on behalf of a company or organization, you represent that you are authorized to bind that company or organization to these Terms.
4. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, current, and complete information when creating an account or purchasing services.
You agree to notify us promptly if you suspect unauthorized access to your account. We are not responsible for losses caused by your failure to secure your account credentials.
5. Customer Content
“Customer Content” means any data, files, text, images, code, emails, prompts, outputs, websites, databases, server data, or other materials that you submit, upload, store, transmit, generate, or process through our services.
You retain ownership of your Customer Content. You grant TRUP LLC a limited license to host, process, transmit, display, and use Customer Content only as necessary to provide, maintain, secure, troubleshoot, and improve the services.
You are responsible for ensuring that your Customer Content complies with applicable laws, third-party rights, and our Acceptable Use Policy.
6. AI-Powered Features
Some TRUP services may include AI-powered or automated features. AI-generated outputs may be inaccurate, incomplete, or unsuitable for your intended purpose. You are responsible for reviewing and validating AI outputs before relying on them.
You must not use AI-powered features to generate unlawful, harmful, deceptive, infringing, abusive, or misleading content. You must not use our services to automate spam, fraud, phishing, scraping, credential theft, or other abusive activities.
7. Hosting, Cloud, Email, and Infrastructure Services
Some services may include hosting, virtual servers, cloud infrastructure, email delivery, domains, DNS, storage, bandwidth, or related infrastructure.
You are responsible for securing your applications, servers, credentials, and configurations. You must not use our infrastructure for spam, phishing, malware, botnets, unauthorized scanning, denial-of-service attacks, illegal content, copyright infringement, or network abuse.
We may suspend or restrict services immediately if we believe your use creates security, legal, operational, reputational, or compliance risk.
8. Payments, Billing, and Taxes
Paid services may be offered as SaaS subscriptions, usage-based services, prepaid credits, one-time purchases, in-app purchases, game items, or custom plans.
You agree to pay all applicable fees, taxes, and charges associated with your use of the services. Prices may be shown in USD or another supported currency. Payment processing may be handled by third-party payment processors.
Unless otherwise stated, subscription fees are billed in advance and automatically renew until canceled. You authorize us and our payment processors to charge your selected payment method for recurring fees, usage fees, renewals, and applicable taxes.
You are responsible for keeping your billing information accurate and up to date.
9. Cancellations
You may cancel a subscription according to the cancellation process available in the applicable product dashboard or by contacting support.
Cancellation stops future renewals but does not automatically entitle you to a refund for the current billing period unless required by law or stated in our Refund Policy.
10. Acceptable Use
You agree to comply with our Acceptable Use Policy, which is incorporated into these Terms. We may suspend, restrict, or terminate access to services if we determine that your use violates our Acceptable Use Policy, these Terms, applicable law, or third-party rights.
11. Third-Party Services
Our services may integrate with third-party providers, including payment processors, cloud providers, analytics and crash-reporting providers, AI providers, email providers, domain registrars, app marketplaces, infrastructure providers, and identity verification providers.
Your use of third-party services may be subject to separate terms and privacy policies. We are not responsible for third-party services, outages, errors, policies, or actions.
12. Intellectual Property
TRUP LLC and its licensors own all rights, title, and interest in our software, websites, systems, designs, APIs, trademarks, logos, documentation, and related intellectual property.
You may not copy, modify, reverse engineer, resell, sublicense, exploit, bypass platform controls, manipulate game mechanics, or create derivative works from our services except as expressly permitted by us in writing or by applicable law.
13. Feedback
If you provide feedback, suggestions, ideas, or recommendations, you grant TRUP LLC a worldwide, royalty-free, perpetual, irrevocable license to use that feedback without restriction or compensation.
14. Service Availability
We aim to provide reliable services, but we do not guarantee uninterrupted, error-free, or always-available operation. Services may be unavailable due to maintenance, upgrades, outages, third-party failures, abuse mitigation, security incidents, or events beyond our control.
15. Service Changes
We may modify, update, suspend, discontinue, or replace any part of the services at any time. Where practical, we may provide notice for material changes, but we are not obligated to continue offering any specific feature, product, or service indefinitely.
16. Confidentiality
If you receive non-public information from TRUP LLC, you agree to protect it from unauthorized use or disclosure and to use it only for the purpose for which it was provided.
17. Disclaimers
The services are provided “as is” and “as available.” To the maximum extent permitted by law, TRUP LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, security, and reliability.
We do not guarantee that the services will meet your requirements, produce specific results, or be free from errors, vulnerabilities, interruptions, or data loss.
18. Limitation of Liability
To the maximum extent permitted by law, TRUP LLC and its owners, officers, employees, contractors, affiliates, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, loss of goodwill, business interruption, or cost of substitute services.
To the maximum extent permitted by law, TRUP LLC’s total liability for any claim relating to the services will not exceed the amount you paid to TRUP LLC for the affected service during the three months before the event giving rise to the claim.
19. Indemnification
You agree to indemnify and hold harmless TRUP LLC and its owners, officers, employees, contractors, affiliates, suppliers, and licensors from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your use of the services, your Customer Content, your violation of these Terms, your violation of law, or your violation of third-party rights.
20. Suspension and Termination
We may suspend or terminate your access to the services if we believe that you have violated these Terms, our Acceptable Use Policy, applicable law, payment obligations, or third-party rights, or if your use creates risk to TRUP LLC, our users, our infrastructure, our payment processors, or third parties.
Upon termination, your right to use the services will cease. We may delete or restrict access to Customer Content after termination according to our data retention practices and applicable law.
21. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the services will be handled in the state or federal courts located in Wyoming, unless another venue is required by applicable law.
22. Changes to These Terms
